Further, nursing homes are required to investigate allegations of violations and injuries of unknown origins and make a report to the proper authorities within five working days of the alleged violation or injury.
- Freedom from Restraints – Nursing homes can’t use any physical restraints or chemical restraints unless they are necessary to treat a resident’s medical symptoms. The law defines a physical restraint as “any manual method or physical or mechanical device, material, or equipment attached or next to the resident’s body that the resident can’t remove easily.” A chemical restraint is a defined as “a drug that is used for discipline or convenience and not required to treat medical symptoms.”
- Proper Medical Care A nursing home resident has the right to full information about his or her health status, the right to choose a physician, participate in medical decisions and have access to medical records.
