J&J's Lack of Credibility Could Help Talcum Powder Victims

The legal troubles plaguing health and beauty product manufacturer Johnson & Johnson have been pretty well-known for some time now. The company, which has been accused of willfully failing to disclose a connection between the use of talcum powder products and ovarian cancer, has suffered several losses injury trials, resulting in massive jury verdicts for plaintiffs. Now, an analyst is warning that this trend is likely to continue due to Johnson & Johnson’s lack of credibility.

In total, J&J has lost four of the first six jury trials, and a report from financial analysis website Seeking Alpha claims that there will be many more massive verdicts in the future. The most recent award was an incredible $417 million verdict to a woman who developed cancer after regular use of J&J’s Baby Powder and Shower-to-Shower powder products. The award, which was granted after a jury trial in California back in August, included $347 million in punitive damages. Johnson & Johnson has also been forced to pay out verdicts of $110 million, $70 million, $55 million, and $72 million, dating back to February 2016.

According to the Seeking Alpha report, the biggest issue plaguing Johnson & Johnson is the lack of credibility in the company’s arguments. Studies have presented contradictory findings when it comes to ovarian cancer and a direct link to talcum powder products, creating a lack of a scientific consensus. However, the studies that Johnson & Johnson have presented in these trials have often been funded directly by Johnson & Johnson themselves. This makes these studies much more difficult for juries to trust, and often has them siding with the sympathetic victim standing as the plaintiff.

This means things are not about to get much better for the health and beauty product mega-giant. More lawsuits are pending currently in Missouri and California courts, where some of the largest victories have been achieved. And on top of that, more than 2,500 plaintiffs are awaiting their trial through the federal court system. These cases have been consolidated and centralized, now being overseen by U.S. District Judge Freda L. Wolfson of the District of New Jersey. Currently the cases are going through a coordinated pre-trial discovery process and several bellwether trials to try to speed up the process.

Johnson & Johnson has been stubborn all throughout this process. Despite several huge losses, the company has outright refused to negotiate settlements with victims and continues to indicate that it will fight back and defend against these claims all across the country. While plaintiffs continue to win cases and point to a growing amount of evidence that suggests Johnson & Johnson knew about the link between the talcum powder products and the chance for ovarian cancer, the manufacturer continues to claim they marketed the product for the use of “personal freshness,” negating the need to disclose such information. So far, juries have disagreed.

The financial impact on Johnson & Johnson could be catastrophic. If Johnson & Johnson loses only ten percent of the cases brought against it from here on out, the cost to the company could be in the range of $34 billion. As the previous record suggests, this is an extremely conservative estimate: Johnson & Johnson lost four of the first six trials brought against it. The actual financial cost could be far higher.
